MendX is a marketing and automation solutions provider specializing in AI-powered tools, chatbot integrations, lead generation systems, and related services. Our registered business is located in Rogers, AR. USA.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you confirm that you meet this requirement and have the authority to enter into a legally binding agreement.

MendX offers, but is not limited to:

Missed Call Text Back (MCTB) systems

AI Website Chatbots

Reputation Management

Social Media Auto-Responders

Related automation, marketing, and consulting services

Service details, features, and pricing may change at any time without prior notice.

4. User Responsibilities

By using our Services, you agree to:

Provide accurate and up-to-date information when requested.

Use the Services only for lawful purposes and in compliance with applicable laws and regulations.

Obtain any required permissions from your customers before adding them to messaging or email lists.

Avoid sending unsolicited spam, harassment, or misleading messages.

5. Messaging & Communication Compliance

If your plan includes SMS, MMS, email, or other digital communications:

You must obtain express written consent from each recipient before sending marketing messages.

You must honor all STOP and unsubscribe requests immediately.

You must comply with all applicable regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier compliance rules for A2P messaging.

MendX is not responsible for any violations resulting from your use of the Services.

6. Payment & Billing

All fees are billed in U.S. dollars.

Setup Fees: All one-time setup fees are non-refundable.

Recurring subscriptions will be automatically charged until canceled.

Late or failed payments may result in suspension or termination of Services.

7. Termination of Services

We may suspend or terminate your account without notice if:

You breach these Terms.

You engage in unlawful or fraudulent activity.

Your use of the Services risks harm to MendX’s reputation, customers, or operations.

You may terminate your account at any time by contacting us in writing.

8. Limitation of Liability

MendX is not liable for:

Any indirect, incidental, or consequential damages arising from your use of the Services.

Loss of profits, data, or business opportunities.

Service interruptions or delays beyond our reasonable control.

Our maximum liability is limited to the amount you paid for the Services in the three (3) months prior to the claim.

9. No Guarantee of Results

While we aim to provide effective solutions, MendX makes no guarantees of specific results, sales, or outcomes. Business performance depends on various factors outside our control.

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. You must review and agree to it before using our Services.

We may update these Terms at any time. Changes will be posted on our website with the updated date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Arkansas, without regard to conflict of law principles. You agree to resolve any disputes in the courts located in Rogers AR.
